If you are entering into this Policy on behalf of a business or other legal entity, you represent that you have the authority to bind such entity to this Policy, in which case the terms "User", "you", or "your" shall refer to such entity. If you do not have such authority, or if you do not agree with the terms of this Policy, you must not accept this Policy and may not access or use the Website and Services.
This Policy is designed to ensure a safe, secure, and positive experience for all our users. It has been developed in accordance with Canadian legislation, including the Personal Information Protection and Electronic Documents Act (PIPEDA), the Consumer Privacy Protection Act (CPPA), and the Canadian Anti-Spam Legislation (CASL). Adherence to this Policy is essential for maintaining the integrity, security, and functionality of our services.

- Illegal Content - Distributing pornography, adult-related content, promoting or facilitating prostitution, escort services, or other illegal activities
- Child Protection - Hosting, distributing, or linking to child pornography or content that is harmful to minors
- Promoting Violence - Promoting or facilitating gambling (unless legally authorized), violence, terrorist activities, or selling weapons or ammunition
- Controlled Substances - Engaging in the unlawful distribution of controlled substances, drug contraband, or prescription medications
- Financial Fraud - Managing payment aggregators or facilitators such as processing payments on behalf of other businesses or charities without proper authorization
- Pyramid Schemes - Facilitating pyramid schemes or other models intended to seek payments from public actors
- Harassment - Threatening harm to persons or property or otherwise harassing behavior
- Impersonation - Purchasing any of the offered Services on someone else's behalf without their knowledge or consent
- Misrepresentation - Misrepresenting or fraudulently representing products or services
- IP Infringement - Infringing the intellectual property or other proprietary rights of others
- Facilitation - Facilitating, aiding, or encouraging any of the above activities through the Website and Services
System Abuse
Any User in violation of the Website and Services security is subject to criminal and civil liability, as well as immediate account termination. System abuse includes but is not limited to the following activities:
- Security Compromise Tools - Use or distribution of tools designed for compromising security of the Website and Services, including but not limited to password crackers, vulnerability scanners, or network probing tools when used maliciously
- Malicious File Transmission - Intentionally or negligently transmitting files containing a computer virus, trojan horse, keylogger, worm, or other malicious code that may cause damage to our systems or other users' data
- Unauthorized Network Access - Accessing another network without permission, including attempting to probe or scan for vulnerabilities or breach security or authentication measures
- Unauthorized Monitoring - Unauthorized scanning or monitoring of data on any network or system, including packet sniffing, network reconnaissance, or any attempt to discover confidential information
- Server Manipulation - Any attempt to undermine, harm, or disrupt the operation of our servers, including but not limited to DDoS (Distributed Denial of Service) attacks, resource exhaustion, or exploitation of software vulnerabilities
- Authentication Bypass - Any attempt to bypass or defeat our authentication systems, including brute force attacks, credential stuffing, or session hijacking
Legal Compliance Note
Violations of system security may violate Canadian federal and provincial laws, including but not limited to the Criminal Code of Canada. We reserve the right to investigate suspected violations and may cooperate with law enforcement authorities in prosecuting users who are involved in such violations.
Security vulnerability research conducted in good faith and in compliance with our Security Vulnerability Disclosure Policy is permitted and encouraged. However, any testing must be conducted in a manner that does not disrupt our services or compromise user data. Please contact our security team before conducting any security testing.
Service Resources
You may not consume excessive amounts of the resources of the Website and Services or use the Website and Services in any way which results in performance issues or which interrupts the Services for other Users. Resource usage that negatively impacts service performance or availability is prohibited.
Prohibited activities that contribute to excessive resource usage include:
- Deliberate Overloading - Deliberate attempts to overload the Website and Services and broadcast attacks (i.e., denial of service attacks) that disrupt normal service operation
- Performance Degradation - Engaging in any activities that degrade the usability and performance of the Website and Services, including excessive API calls, bandwidth usage, or computational resources
- Malicious Code - Hosting or running malicious code or other scripts or processes that adversely impact the Website and Services or their security
- File Sharing - Operating a file sharing site or scripts for BitTorrent or similar peer-to-peer file sharing services, which includes sending or receiving files containing these mechanisms
- Web Proxies - Web proxy scripts, such as those that allow anyone to browse to a third-party website anonymously, are prohibited due to potential misuse and resource consumption
- Cryptocurrency Mining - Using our services for cryptocurrency mining or other computationally intensive tasks unrelated to the intended purpose of our services
- Automated Scraping - Conducting automated scraping, data mining, or data extraction activities that exceed reasonable request rates and burden our systems
We monitor system resources and may limit or suspend accounts that consume excessive resources that negatively impact overall system performance. If you anticipate temporary high resource usage for legitimate purposes, please contact our support team in advance to discuss your needs.
Anti-Spam Policy
You may not use the Website and Services to send spam or bulk unsolicited messages. Tridacom maintains a zero-tolerance policy for the use of its Website and Services in any manner associated with the transmission, distribution, or delivery of unsolicited bulk or unsolicited commercial messages.
Our anti-spam policy prohibits:
- Bulk Commercial Email - Sending or facilitating the sending of unsolicited bulk or commercial email messages
- CASL Non-Compliance - Sending commercial email that does not comply with the Canadian Anti-Spam Legislation (CASL) requirements, including proper identification, unsubscribe mechanisms, and express/implied consent provisions
- Harvesting Emails - Using our services to collect or harvest email addresses for the purpose of sending unsolicited communications
- Misleading Headers - Sending messages with deceptive or misleading header information, including spoofed email addresses or forged sender details
- Cross-Platform Spamming - Spam activities conducted via fax, phone, postal mail, instant messaging, or newsgroups in association with our services
- Spamvertised Products - Products or services advertised via spam (i.e., Spamvertised) may not be used in conjunction with the Website and Services
Violations of this anti-spam policy may result in immediate service suspension or account termination without notice or refund. Tridacom reserves the right to take all legal and technical steps available to prevent spam and unsolicited bulk messaging from entering, utilizing, or residing on our network.
CASL Compliance Note
Canada's Anti-Spam Legislation (CASL) is one of the strictest anti-spam laws in the world, with penalties that can include administrative monetary penalties up to $10 million CAD for corporations. All electronic communications sent through our services must comply with CASL requirements, including obtaining proper consent, providing identification information, and including a working unsubscribe mechanism.
Defamation & Content Standards
We value freedom of expression and encourage Users to be respectful with the content they post. While Tridacom is not a publisher of User content and is not in a position to investigate the veracity of individual defamation claims or to determine whether certain material is defamatory or objectionable, we maintain content standards to protect our users and services.
The following content standards apply to all User contributions:
- Legal and Accurate - Content must comply with applicable laws and regulations and not be misleading, fraudulent, or deceptive
- Respectful - Content should be respectful of others and should not include personal attacks, harassment, hate speech, or discrimination based on race, gender, religion, nationality, disability, sexual orientation, or age
- Non-Defamatory - Content that is defamatory, libelous, maliciously false, or unfairly critical of any person, business, or organization is prohibited
- Good Taste - Content must be appropriate for a professional environment and not contain excessive profanity, obscenity, or offensive material
- Privacy Respecting - Content must not invade another's privacy or reveal personal or confidential information without authorization
- Non-Harmful - Content must not promote, encourage, or facilitate violence, self-harm, or cruelty to humans or animals
We reserve the right to moderate, disable, or remove any content to prevent harm to others or to Tridacom or the Website and Services, as determined in our sole discretion. Content moderation decisions are based on maintaining a safe and respectful environment for all users, and may be made without prior notice.
Intellectual Property
Copyrighted material, trademarks, and other proprietary information must not be published via the Website and Services without the explicit permission of the copyright owner or a person explicitly authorized to give such permission by the copyright owner.
Intellectual property protections:
- Copyright Claims - Upon receipt of a claim for copyright infringement, or a notice of such violation, we will immediately conduct a full investigation and, upon confirmation, will notify the person or persons responsible for publishing it and, in our sole discretion, will remove the infringing material
- Repeat Infringers - We may terminate the Service of Users with repeated copyright infringements or intellectual property violations
- No Liability - We will assume no liability to any User of the Website and Services for the removal of any such material
- Fair Use - Legitimate use of copyrighted materials consistent with the principles of fair dealing under Canadian copyright law is permitted, but Users remain responsible for determining whether their use qualifies as fair dealing
- AI-Generated Content - Users must ensure that any AI-generated content uploaded or shared through our services does not infringe on third-party copyrights or intellectual property rights

Security Requirements
You take full responsibility for maintaining reasonable security precautions for your account and any data you manage or process while using our services. Security measures are essential for protecting both your information and our network integrity.
Security obligations for all users:
- Account Protection - You are responsible for protecting and updating any login account provided to you for the Website and Services
- Password Management - You must protect the confidentiality of your login details, use strong, unique passwords, and change your password periodically (recommended every 90 days)
- Multi-Factor Authentication - When available, you should enable multi-factor authentication to provide an additional layer of security

We make no warranty express or implied for the security and operability of third-party software or scripts installed or run by you on the Website and Services. Security incidents resulting from user-installed software or inadequate account security are the responsibility of the user.
Enforcement Measures
We reserve our right to be the sole arbiter in determining the seriousness of each infringement and to immediately take corrective actions. Violation of this Policy may trigger various enforcement mechanisms, proportional to the severity and frequency of the violations.
Our enforcement actions may include:
- Service Suspension - Suspending or terminating your Service with or without notice upon any violation of this Policy
- Account Termination - Serious violations may result in the immediate suspension or termination of your account without prior warning
- Content Removal - Disabling or removing any content which is prohibited by this Policy, including to prevent harm to others or to us or the Website and Services, as determined by us in our sole discretion
- Legal Action - Reporting violations to law enforcement as determined by us in our sole discretion
- Response Requirements - A failure to respond to an email from our abuse team within 2 days, or as otherwise specified in the communication to you, may result in the suspension or termination of your account
Suspended and terminated User accounts due to violations will not be re-activated. Nothing contained in this Policy shall be construed to limit our actions or remedies in any way with respect to any of the prohibited activities. In addition, we reserve at all times all rights and remedies available to us with respect to such activities at law or in equity.
Reporting Violations
If you have discovered and would like to report a violation of this Policy, or if you believe your service has been compromised or misused in any way, please contact us immediately. We take all reports of violations seriously and will investigate each one.
When reporting a violation, please provide:
- A description of the violation
- The date and time (with time zone) of the violation
- The identity of the person or entity violating the policy (if known)
- Any identifying information of the violator (such as email address, IP address, username)
- Evidence of the violation (such as logs, screenshots, etc.)
- Your contact information so we can follow up with you if necessary

Whistleblower Protection
Tridacom is committed to investigating all reported violations while protecting the identity of individuals who report violations in good faith. No retaliatory action will be taken against any user who reports a suspected violation of this Policy or any law in good faith.
Changes and Amendments
